Tenant Rules in Dubai

 Recently, the UAE has witnessed an increase in the number of expats, which has led the housing societies to revise the rules. The tenancy rules in Dubai are revised with additional information required of the occupant and the owner of the accommodation. These instructions are sent out from Dubai Land Development (DLD) to the property owners, tenants, and developers. Registration:

The information can be registered on the Dubai REST app within 14 days. However, the process involves tenants following eight steps, where they have to provide their details and information about their Emirates ID. 

Registration is mandatory for tenants and other occupants, including family members and house staff, who have been staying in Dubai for at least a month. However, the DLD elaborates on the registration. The tenant must not hide the details of other people living with them as it could have serious legal implications, such as a violation of the law. Once the co-occupants and tenants have registered themselves through the Dubai REST app, they will be enlisted in the Ejari tenancy contract. The co-occupants and tenants should include the following personal details in the registration:

  • Full name
  • Emirates ID numbers
  • Passport copy (in case they do not have Emirates ID)

The registration will be proof of residency but cannot be used in a rental agreement for government transactions. Co-occupant registration is mandatory, but the rental agreement does not require every occupant’s name. It will include the main tenant’s name. The tenancy agreement is signed between the property owner and the tenant. The agreement has all the terms and conditions of the property usage to ensure that tenants agree. 

The authorities in Dubai are keeping a statistical record of the inhabitants. This step by DLD is taken to inform the government entities about the needs of the citizens, residents, and tourists, as foreigners are coming more often to settle in Dubai. However, the registration of properties is not restricted to apartments only; villas also have to register under the same new law of tenancy. 

The foremost rule of shared apartments is that sharing accommodation is only allowed if the landowner consents to the tenant. Further guidelines for cohabitation are mentioned for the tenants:

  • The tenant can only sublease the already rented accommodation without asking permission from the landlord. The consent has to be a written approval. The subtenants can lease the premises if the landlord allows it and if the rental agreement is valid.
  • The sublease contract defines the relationship between the tenant and the subtenant. However, the tenant must be obligated to the agreement that was initially signed with the landlord. The contract must remain unchanged. Dubai municipality will inspect the enforcement of the New Rule. They will ensure that every resident is comfortable and safe in their homes and is not bothered by the tenants over the rental agreement. The inspections initiated to enforce the new rule showed that some residents needed to be made aware of the new tenancy rule, which is why enforcement is important in Dubai.
